Terms of service
These terms cover your use of tutor.fish. By creating an account you agree to them.
The service
tutor.fish is booking software provided by Cloud WiFi Limited (13521157), 19 Shanklin Road, London, N8 8TJ. It takes bookings through a hosted page, an embeddable widget, and WhatsApp, and sends confirmations and reminders to the people who book.
Trial, pricing and billing
New accounts get a 14-day free trial. No card is required to start.
After the trial, the subscription is charged monthly in US dollars through Stripe, at the price set for your territory — shown to you before you subscribe, and on your billing page at any time. The price is per business, never per user, per seat or per booking. Taking bookings is always unlimited and free, and is never affected by your credit balance. Each plan includes a monthly allowance of message credits, which pay for the WhatsApp and email messages the service sends on your behalf; your allowance and your remaining balance are shown on your billing page. If the allowance runs out, booking reminders are sent by email instead of WhatsApp, while booking confirmations are always sent — no booking is ever blocked. You can buy additional credits at any time, and purchased credits do not expire.
Subscriptions renew monthly until cancelled. You can cancel at any time from your dashboard; access continues to the end of the period you have paid for. We do not refund part-months, and we do not charge per booking or take commission.
If we change our prices we will give you at least 30 days’ notice by email before the change affects you.
Your responsibilities
You are responsible for the accuracy of what you publish through the service — your hours, services, prices and availability — and for honouring the bookings you accept.
You must have a lawful basis for messaging the people you add or who book with you, and you must meet the messaging rules set out under “Acceptable use” below.
You are responsible for keeping your account credentials secure and for what your team does under your account.
Acceptable use
Do not use the service to break the law, infringe anyone’s rights, or send abusive, deceptive or harassing messages. Do not attempt to access another business’s data, probe or disrupt the service, or resell it as your own without our written agreement.
Who you may message. You may message a person only where they gave you their number or email in connection with a booking, or have otherwise consented. Do not upload, buy, scrape or otherwise import contact lists. Every message we send on your behalf must relate to a specific booking — confirmations, changes, reminders, cancellations. Marketing, promotional and bulk messaging are not permitted through the service, whatever the recipient’s consent status.
Meta’s rules apply too. You must comply with the WhatsApp Business Messaging Policy and Meta’s related business policies as they change from time to time. Meta applies its own controls to the sending number and can restrict, throttle or block delivery independently of us. We cannot override that, and a restriction imposed by Meta is not a failure of the service.
Shared sending infrastructure. Your messages may be sent through infrastructure shared with other businesses, so conduct that damages its standing affects everyone using it. Where your sending attracts recipient blocks, spam reports or a quality downgrade, we may cap, suspend or withdraw your access to WhatsApp sending — including immediately and before contacting you — while continuing to deliver your notifications by email. That is a protective measure, not a termination of your account.
Do not attempt to circumvent, falsify or interfere with the metering of messages, your credit balance, or any usage limit that applies to your account.
We may suspend an account that breaches these terms. Where the breach is serious — fraud, or abuse of the messaging channel that puts the platform at risk — we may suspend immediately; otherwise we will tell you what is wrong and give you a reasonable chance to put it right. Repeated or unremedied breaches may end the agreement under “Ending the agreement” below.
Availability
We work to keep the service running and take backups, but we do not offer a guaranteed uptime level on these plans. Maintenance, outages at our providers, and WhatsApp platform changes can all interrupt service.
WhatsApp delivery depends on Meta’s platform and on the recipient. Where a WhatsApp message cannot be delivered, or your monthly WhatsApp allowance is used up, we fall back to email — this is by design and is not a service failure.
Your data
Your bookings and customer records are yours. You can export them as CSV at any time, and you can erase an individual customer’s personal information from your dashboard.
How we handle personal information is set out in the privacy policy, which forms part of these terms.
Liability
The service is provided as-is. To the extent the law allows, we are not liable for lost profits, lost bookings, or indirect or consequential loss, and our total liability in any 12-month period is limited to the amount you paid us in that period.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
Ending the agreement
You can cancel at any time from your dashboard. We may end the agreement on 30 days’ notice, or immediately for a serious breach. Either way you can export your data before access ends.
Governing law
These terms are governed by the laws of England and Wales, and its courts have jurisdiction over any dispute.
